Soluția pe scurt: Admite cererea de îndreptare a erorii materiale formulată de SINDICATUL Ambulanţa Vâlcea.
Dispune îndreptarea erorii materiale strecurate în sentinţa civilă nr. 463/26.02.2025 pronunţată în dosarul nr. 1748/90/2024 al Tribunalului Vâlcea – Secţia I Civilă, în sensul că se va reţine ca fiind corect redactat în ultimul alineat al sentinţei (fila 7) şi alineatul 3 al minutei şi dispozitivului : „Anexa VII art. 1 din Legea nr. 153/2017”, precum şi numele reclamanţilor Tătaru Constantin şi Bosoaga Daniela Florentina, în loc de „Tataru Constantin Florentina”.
Cu drept de apel în termen de 10 zile de la comunicare. În cazul exercitării căii de atac, cererea se va depune la Tribunalul Vâlcea.
Pronunţată prin punerea soluţiei la dispoziţia părţilor prin mijlocirea grefei instanţei, astăzi, 04.06.2025.

Soluția pe scurt: Admite, în parte, acţiunea formulată de Sindicatul Ambulanţa Vâlcea pentru cei 109 reclamanţi membri de sindicat din cerere, în contradictoriu cu Serviciul Judeţean de Ambulanţă Vâlcea.
Obligă pârâtul Serviciul Judeţean de Ambulanţă Vâlcea să calculeze şi să achite fiecărui reclamant salariul de bază stabilit conform art. 12 alin. 2 din Legea nr. 153/2017, începând cu data de 01.01.2023.
Obligă pârâtul Serviciul Judeţean de Ambulanţă Vâlcea să procedeze, prin emiterea de decizii de reîncadrare, la stabilirea salariului de bază pentru funcţiile deţinute de fiecare reclamant indicat la poziţia 94-108 în cerere, în conformitate cu Anexa nr. VII din Legea nr. 153/2017, precum şi la plata diferenţelor salariate rezultate, actualizate cu indicele de inflaţie şi dobânda legală penalizatoare până la plata efectivă, calculate de la data de 05.06.2021 şi până la emiterea de noi decizii.
Obligă pârâtul Serviciul Judeţean de Ambulanţă Vâlcea să calculeze şi să achite fiecărui reclamant indicat la poziţia 94-108 în cerere salariul de bază stabilit conform art. 38 alin. 4 din Legea nr. 153/2017, începând cu data de 01.01.2022, precum şi la plata diferenţelor salariale rezultate, actualizate cu indicele de inflaţie şi dobânda legală penalizatoare până la plata efectivă.
Obligă pârâtul Serviciul Judeţean de Ambulanţă Vâlcea să calculeze şi să achite fiecărui reclamant, indicat la poziţia 94-108 în cerere, sporul de 15% pentru lucrul în condiţii periculoase, stabilit conform art. 10 lit. a din Anexa VII la Legea nr. 153/2017, începând cu data de 19.01.2020, actualizat cu indicele de inflaţie şi dobânda legală penalizatoare până la plata efectivă.
Respinge în rest acţiunea.
Cu drept de apel în termen de 10 zile de la comunicare. în cazul exercitării căii de atac, cererea se va depune la Tribunalul Vâlcea.
