Soluția pe scurt: Respinge cererea formulată de apelant prin care a solicitat suspendarea judecăţii apelului, în baza art. 413 alin. (1) pct. 11 din Codul de procedură civilă, până la pronunţarea de către Curtea de Justiţie a Uniunii Europene a hotărârii preliminare asupra sesizării înregistrate cu nr. C-706/23, formulate de Curtea de Apel Iaşi în dosarul nr. 2310/89/2022, ca neîntemeiată. Admite cererea formulată de apelant prin care a solicitat suspendarea judecăţii apelului, în baza art. 413 alin. (1) pct. 11 din Codul de procedură civilă până la pronunţarea de către Curtea de Justiţie a Uniunii Europene a hotărârii preliminare, ca urmare a sesizării formulate de Curtea de Apel Constan?a în dosarul nr. 1361/88/2023. În baza art. 413 alin. (1) pct. 11 din Codul de procedură civilă, suspendă judecarea cererii de apel formulate de apelantul reclamant SINDICATUL NAŢIONAL AL EDUCATORILOR - FEN în numele membrilor de sindicat Agachi Camelia-Anişoara, Avram Mădălina, Bănulescu Roxana Georgiana, Buduru Eugenia, Cernea Teodora-Elena, Cioparu Georgiana Raluca, Crânganu Sorana-Rela, Cristea Georgeta, Cuşma Mihaela Danaida, Dediu Gabriela-Alexandra, Ditică Petronela, Dragomir Anişoara, Geles Corina, Gogor Mariana, Grigore Florina, Macarie Valentina, Neagoe Iuliana Mădălina, Nedelcu Maria, Oprea Polixenia, Petre Elena Ramona, Petrovici Mirela Claudia, Popia George, Radu Carmen-Florica, Rizea Mariana Sanda, Vasilescu Irina, Florescu Roxana-Mihaela, Teodoraşcu Ionel-Remus, împotriva sentinţei civile nr. 2894 din data de 22.04.2024, pronunţată de Tribunalul Bucureşti - Secţia a VIII-a Conflicte de Muncă şi Asigurări Sociale în dosarul nr. 1898/3/2024, în contradictoriu cu intimata pârâtă GRĂDINIŢA NR. 116, până la pronunţarea de către Curtea de Justiţie a Uniunii Europene a hotărârii preliminare, ca urmare a sesizării formulate de Curtea de Apel Constan?a în dosarul nr. 1361/88/2023. Cu drept de recurs pe toată durata suspendării, care se va depune la Curtea de Apel Bucure?ti-Secţia a VII-a pentru cauze privind conflicte de muncă şi asigurări sociale. Pronunţată azi 23.01.2025, prin punerea soluţiei la dispoziţia părţilor prin mijlocirea grefei instanţei potrivit art. 402 teza a II-a din Codul de procedură civilă.

Soluția pe scurt: Respinge cererea de chemare în judecată ca neîntemeiată. Cu apel in termen de 10 de zile de la comunicare, ce se depune la Tribunalul Bucureşti-Secţia a VIII-a. Pronunţată astăzi, 22.04.2024, prin punerea soluţiei la dispoziţia părţilor de către grefa instanţei. Cu opinie separată a asistenţilor judiciari Dimofte Laura şi Eleonora Băloi în sensul admiterii în parte a ac?iunii, după cum urmează: Admite în parte cererea de chemare în judecată. Dispune obligarea pârâtei la recalcularea indemnizaţiilor de concediu de odihnă, raportat la perioada efectiv lucrată în perioada 2019 – 31.08.2023, prin includerea în baza de calcul a acestora a indemnizaţiei de hrană de care au beneficiat reclaman?ii în perioada men?ionată. Dispune obligarea pârâtei la plata către reclaman?i a diferenţelor salariale dintre cuantumul indemnizaţiilor de concediu de odihnă recalculate şi cele încasate, sumele datorate urmând a fi actualizate în raport de rata infla?iei la data plăţii, precum şi cu dobânda legală penalizatoare, calculată de la data scaden?ei fiecărui drept şi până la achitarea efectivă. Respinge în rest cererea de chemare în judecată.
