Soluția pe scurt: Admite acţiunea. Obligă pârâta să calculeze şi să achite membrilor de sindicat drepturile salariale constând în diferenţa dintre drepturile salariale încasate si drepturile cuvenite, prin acordarea salariului de bază conform art. 39 alin. 6 din Legea nr. 153/2017, astfel cum a fost modificată si completată prin O.U.G. nr. 91/2017, respectiv prin acordarea salariilor de bază prevăzute în anexa la H.G. nr. 38/2017, de la data de la care fiecare membru de sindicat îndeplineşte cerinţele de trecere într-o nouă treaptă de vechime, dar nu mai mult de 3 ani anterior datei introducerii prezentei acţiuni (03.08.2021) şi până la aplicarea integrală a prevederilor Legii 153/2017, drepturile restante urmând a fi actualizate în funcţie de coeficientul de inflaţie, la care se adaugă dobânda legală penalizatoare aferentă, până la data plăţii efective. Executorie de drept. Cu drept de apel în termen de 10 zile de la comunicare. Sub sancţiunea nulităţii, cererea de apel urmând a se depune la Tribunalul Buzău. Pronunţarea se va face prin punerea soluţiei la dispoziţia părţilor prin mijlocirea grefei instanţei, astăzi, 20.01.2022.
