Soluția pe scurt: Respinge excepţia inadmisibilităţii invocată de pârâta S.C. Kappa Invest S.R.L. Admite cererea formulată. Lămureşte sentinţa nr.293/09.04.2021, pronunţată de Tribunalul Bacău în dosarul nr.567/110/2021, în sensul că suspendarea executării Autorizaţiei de construire nr. 194/31.08.2020, emisă de pârâtul Primarul Municipiului Bacău în favoarea pârâtei S.C. Kappa Invest S.R.L., a fost dispusă până la până la soluţionarea definitivă a acţiunii în anulare. Cu drept de recurs în termen de 15 zile de la comunicare, cale de atac ce se va depune la Tribunalul Bacău, sub sancţiunea nulităţii. Pronunţată în condiţiile art. 402 teza a II-a Cod procedură civilă, azi 22.07.2025.
