Soluția pe scurt: Respinge excepţia lipsei calităţii procesuale active a reclamanţilor în ceea ce priveşte obligarea ICCJ să aloce fondurile necesare pentru plata drepturilor salariale.
Admite cererea de chemare în judecată formulată de reclamanţi în contradictoriu cu Curtea de Apel Suceava.
Obligă pârâta Curtea de Apel Suceava la recalcularea indemnizaţiilor de concediu de odihnă, prin includerea în cuantumul acestora şi a indemnizaţiei de hrană, începând cu data de 16.05.2020 şi în continuare pentru viitor.
Obligă pârâta Curtea de Apel Suceava să plătească reclamanţilor diferenţelele dintre indemnizaţia de concediu cuvenită potrivit celor de mai sus şi cea efectiv achitată, începând cu data de 16.05.2020, sumă actualizată cu rata inflaţiei la data plăţii, precum şi la plata dobânzii legale, calculată de la data scadenţei şi până la data plăţii efective.
Respinge în rest pretenţiile formulate în contradictoriu cu pârâta Curtea de Apel Suceava ca neîntemeiate.
Respinge ca neîntemeiate pretenţiile formulate în contradictoriu cu pârâta Înalta Curte de Casaţie şi Justiţie.
Cu drept de apel în termen de 10 zile de la comunicare.
Cererea de apel se depun la Tribunalul Cluj.
Pronunţată prin punerea soluţiei la dispoziţia părţilor prin grefa instanţei, azi, 06.12.2023.
