Soluția pe scurt: Admite în parte cererea de chemare în judecată formulată de reclamanţi, prin sindicat, în contradictoriu cu pârâta Garda de Coastă. Obligă pârâta Garda de Coastă să recalculeze drepturile băneşti cuvenite reclamanţilor pe perioada concediilor de odihnă efectuate după data de 21.08.2022, prin includerea, după caz, a sporurilor prevăzute de articolul 12 alineatul (2) din anexa nr. VI la Legea-cadru nr. 153/2017 de care fiecare reclamant a beneficiat efectiv în perioada de activitate, corespunzător timpului lucrat în locurile de muncă respective, ?i să plătească diferen?ele salariale rezultate. Obligă pârâta Garda de Coastă să actualizeze diferenţele salariale astfel stabilite cu indicele de inflaţie şi să plătească dobânda legală aferentă, pentru fiecare sumă, de la data scadenţei şi până la data plăţii efective. Obligă pârâta Garda de Coastă ca, pe viitor, în măsura în care reclamanţii îndeplinesc condiţiile legale şi beneficiază efectiv de sporurile prevăzute de articolul 12 alineatul (2) din anexa nr. VI la Legea-cadru nr. 153/2017, să includă aceste sporuri în drepturile băneşti cuvenite pe perioada efectuării concediului de odihnă. Respinge ca prescrise pretenţiile privind plata diferenţelor salariale aferente perioadei anterioare datei de 21.08.2022. Respinge pretenţiile de plată aferente perioadelor în care reclamanţii Căldăraru Răzvan Marian, Tufan Ana Maria, Sima Ionela Ana şi Şobache George nu au avut raporturi de serviciu cu pârâta Garda de Coastă. Cu drept de recurs în termen de 15 zile de la comunicare, recurs ce se va depune la Tribunalul Constanţa – Secţia de contencios administrativ şi fiscal. Pronunţată astăzi, 27.01.2026, prin punerea soluţiei la dispoziţia părţilor prin mijlocirea grefei instanţei.
