Soluția pe scurt: Admite exceptia lipsei calitătii procesuale pasive a pârâtei Curtea de Apel Constanta si, pe cale de consecintă, respinge actiunea formulată în contradictoriu cu această pârâtă, ca fiind formulată împotriva unor persoane fără calitatea procesuală pasivă.
Admite exceptia de prescriptie a dreptului material la actiune în ceea ce priveste pretentiile aferente perioadei 01.08.2016-31.12.2017 si, pe cale de consecinta, respinge cererea privind pretentiile aferente perioadei 01.08.2016-31.12.2017, ca fiind prescrisă.
Respinge exceptia lipsei de interes, ca neîntemeiată.
Admite în parte cererile de chemare în judecată conexate.
Obligă pârâtul Tribunalul Constanta la recalcularea pentru reclamanti a indemnizatiilor de încadrare raportat la un indice de valoare sectorială de 605,225 lei +25%, majorare prevăzută de art 38 alin.3 din Legea 153/2017, începând cu data de 01.01.2018 si în continuare, fără aplicarea plafonului prevăzut de art 38 alin.6 din Legea 153/2017, în raport de perioadele lucrate de fiecare reclamant.
Obligă pârâtul Tribunalul Constanta la plata către reclamanti a diferentelor bănesti dintre drepturile salariale efectiv plătite si salariile rezultate din recalcularea indemnizatiilor de încadrare raportat la un indice de valoare sectorială de 605,225 lei +25%, majorare prevăzută de art 38 alin.3 din Legea 153/2017, începând cu data de 01.01.2018 ?i în continuare fără aplicarea plafonului prevăzut de art 38 alin.6 din Legea 153/2017, în raport de perioadele lucrate de fiecare reclamant, sume ce vor actualizate cu indicele de inflatie la data plătii efective la care se adaugă dobânda legală penalizatoare de la data scadentei lunare a fiecărei sume si până la data plătii efective.
Cu apel în termen de 10 zile de la comunicare.
Cererea de apel se depune la Tribunalul Brăila.
Pronuntată azi 20.03.2025 prin punerea solutiei la dispozitia părtilor prin intermediul grefei instantei.
